Social Fibre has created these terms and conditions in order to demonstrate entity commitment to your privacy. These conditions explain the policies put in place and used by Social Fibre, to protect your privacy as you use our services or visit the website www.socialfibre.com.au. Your use of the Social Fibre services constitutes an acceptance of our Terms and Conditions. By accepting terms and conditions, you sign an agreement (the "Agreement"), which defines the relationship between Social Fibre ("Social Fibre", the "Company", "we", or "our") and you ("you", "your", the "Customer"). Social Fibre provides privacy–related services (the "Services") for the Customer or someone (e.g., the Customer's child) that the Customer has designated to be the subject of the Services provided by Social Fibre (the "Named Party").

Relationship
Customer is an independent entity and is not a strategic partner, franchisee, agent or employee of Social Fibre. Social Fibre is an independent entity and is not a strategic partner, franchisee, agent or employee of Customer. Neither party will refer to the other party as anything implying a partnership type of arrangement.

Ethical Representation
Social Fibre will only take on clients whose businesses are ethical and decline to promote information if we do not believe it is in the best public interest. Social Fibre has a strict company policy regarding the representation of those who have been accused of a criminal act. Prior to representation of a Customer of that nature, Social Fibre will need to be provided with legal documentation regarding the matter and Customer will need to be innocent of the crime to which they were accused. If a case was brought against the potential Customer, the potential Customer will need to provide Social Fibre with legal court documents stating that they were found innocent of the accusation or the accusation was dropped and/or dismissed both criminally and civilly. Social Fibre will not represent anyone found guilty of a criminal act involving sexual based offense(s). Social Fibre will not represent any client for any sexual matter unless it can be proved that they are innocent both criminally and civilly. Social Fibre has the right to refuse service for any reason or no reason at all.

Social Fibre will evaluate each case based on the individuals search results or company’s circumstances. Social Fibre does not support, condone and or wish to represent any company’s convicted of Fraud, Convicted Felons and Felonies and or other convicted criminal activity.

Social Fibre reserves the right to cancel any program for elevated complaints and or unethical business practices. Social Fibre also reserves the right to delete posts created for the program if the client is convicted of a felony and or serious crime. Social Fibre does not support, condone and or adopt any view point and or opinions pertaining to the client’s content displayed in the search engine results. Social Fibre does not endorse, support the opinions, decisions and or actions of the client. Social Fibre reserves the right to alter and or change this policy at any time without notice. This ethics policy is a guideline for our company to follow to provide the best possible and ethical service to our customers. Social Fibre does not allow its service to be used for illegal activities, nor activities that Social Fibre deems improper for any reason whatsoever at its sole judgment. Social Fibre reserves the right to take preventative or corrective actions to protect itself and its customers, subscribers, and users. Malicious or fraudulent use of the Services is absolutely forbidden.

Confidentiality
The existence of this Agreement, and all information obtained from, or developed for, or on behalf of Customer by Social Fibre as part of this Agreement, including but not limited to Marketing Collaterals, Graphics, Client data, Business plans and Financial information, Database files, and Email communication, is to be kept strictly confidential by Social Fibre and is not to be shared with any outside third–party, without receiving prior written approval from the Customer unless it is deemed necessary for completion of your program by Social Fibre.

Term and Termination
This Agreement shall remain in effect until a new agreement is executed and mutually agreed upon by both Social Fibre and the Customer or until arbitration rules otherwise. Social Fibre may terminate this Agreement by written or verbal notice to the other party, for any reason or no reason at any time. All Information collected for the Customer is to remain the exclusive property of the Customer. Social Fibre will not rent, sell or lease any information.

Effect of Termination
Within 30 (thirty) calendar days after termination of this Agreement, Social Fibre will transfer ownership of all data, username and passwords to Customer. All pending fees will survive termination of this agreement.

Social Fibre is the sole owner of the information collected on www.socialfibre.com.au and in other means.

Website features
Newsletters: If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. Out of respect for your privacy, we provide you a way to unsubscribe.

This Website contains links to other sites that are not owned or controlled by Social Fibre. Please be aware that we, Social Fibre, are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every Website that collects personally identifiable information.

Usage of customer personal data
We disclose information that we, in good faith, believe is appropriate to cooperate in investigations of fraud or other illegal activity, or to conduct investigations of violations of our Agreement. For example, this means that if we conduct a fraud investigation and conclude that one side has engaged in deceptive practices, we can give that person or entity's contact information to victims who request it.

We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court–appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action. If the subpoena seeks information about an identified customer or limited group of customers, we'll make reasonable business efforts to contact the client (s) before providing information to the party that requests it. We can't guarantee that we'll be able to in all cases, whether because of a time limit, court order, inability to effectively contact a client, or for any other reason.

We disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).

We may use aggregated information to evaluate which products and services are successful and which ones are not, and in order to evaluate which new services we should make available on our website.

Changes
If we decide to change our privacy policy, we will post those changes to this privacy statement so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our homepage. You are responsible for regularly reviewing the Privacy Statement and related documents. No amendment to or modification of this Statement will be binding unless in writing and signed by a duly authorized representative of Social Fibre or posted to the Social Fibre website by a duly authorized representative of Social Fibre.

Guarantees and warranties
Social Fibre does not guarantee or warrant that we will find or communicate to you every example or all examples of Internet content about the Customer or the Named Party that he or she has designated as the subject of the searches to be undertaken by the Company. Social Fibre, moreover, does not guarantee or warrant that it will be successful in effecting removal or alteration, if such service is to be performed, of any Internet content about the Customer or the Named Party he or she has designated as the subject of the searches to be undertaken by the Company.

Social Fibre does not guarantee the Service will be operable at all times or during any down time (1) caused by outages to any public Internet backbones, networks or servers, (2) caused by any failures of your equipment, systems or local access services, (3) for previously scheduled maintenance or (4) relating to events beyond Social Fibre's control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labor conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where Social Fibre’s servers are located or co–located. Complete accuracy in all aspects of your reports at all times also is not guaranteed.

Customer responsibilities
You authorize us to be your privacy advocates. In this role, we might contact third parties, including creators of unwelcome content, hosts of unwelcome content, and other parties who might have control or authority over such content. You authorize us to take such action on your behalf, via email, via personal meeting, or via the Australia Postal Service or other courier service, and to identify ourselves as acting on your behalf. You recognize that such contact may have unpredictable side–effects, including but not limited to negative responses from others. We are not your lawyer and cannot dispense legal advice, nor does this Agreement or the Services create any attorney–client relationship or legal representation.

If you purchase any of the Social Fibre services, then you agree to any paragraphs in these Terms and Conditions Agreement. You agree to provide the information required by the service, and understand that the better the information you provide the better results you'll see. You authorize us to use your information to search the Internet and the "deep web" using any tools available. You authorize us to use the information you provide to create and publish web content. You grant us the right to publish any or all of the content you provide on any websites we deem fit for the purposes of the service. You authorize us to modify any content as we see fit to provide the service. You warrant that you have the right to distribute the content you provide us, and to indemnify us against any damages arising from the use of the content you provide, whether due to copyright infringement or other reason. You authorize us to act on your behalf in creating accounts on other sites in your name. If you are no longer an active service customer then you may request information about your accounts on other sites during the 30 days following the end of your agreement period. The availability of service representatives is specified when you sign up. In addition to the general release, below, you specifically release and hold us harmless for all damages caused as a result of the service, including any damages resulting from publication of the content you provide us, disclosure of your relationship with Social Fibre, or any other cause.

Users of Social Fibre services must truthfully and accurately represent their identities in using the Company's Services. Any customer of the Company's Service must be the same person for which our Service is intended, or the customer must otherwise indicate and verify with Social Fibre the Named Person's (ie, beneficiary's) consent to a third party. You represent and warrant that you are truthfully representing your identity, and agree to release and hold harmless Social Fibre for any loss or damage to you resulting from a false or inaccurate representation of identity. Further, you agree to indemnify Social Fibre against any loss or damage caused to Social Fibre resulting from fraudulent or malicious representations of identity made to Social Fibre.

In connection with the Services, Social Fibre may collect additional information about you (for example, known usernames/screennames, addresses, etc). You represent and warrant that all information you provide in connection with Social Fibre Services is correct and accurate to the best of your knowledge. The ability of Social Fibre to locate Internet content concerning the Customer is limited by the quality of information provided. You agree to release and hold harmless Social Fibre from any loss or damage caused to you resulting from inaccurate or false representations of information. Further, you agree to indemnify Social Fibre against any loss or damage caused to Social Fibre resulting from fraudulent or malicious representations of information made to Social Fibre. The services offered by Social Fibre may change at any time. The methods used to provide services may change at any time. The pricing of services may change at any time. Glitches are to be expected in a technology–driven product. By accepting these terms you represent that you are aware that Social Fibre is a technology–driven service and accept any glitches, bugs, delays, and other problems to be expected with such a service.

Limitation and Liability
You agree that you will hold harmless Social Fibre at your expense, any and all third–party claims, actions, proceedings, and suits brought against Social Fibre or any of its officers, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, without limitation, reasonable attorneys' fees and other litigation expenses) incurred by Social Fibre or any of its officers, arising out of or relating to (i) your breach of any term or condition of this Agreement, (ii) your fraudulent or malicious use of the Services, (iii) your violation of applicable laws, rules or regulations in connection with the Services. In such a case, Social Fibre will provide you with written or electronic notice of such claim, suit or action. You shall cooperate as fully as reasonably required in the defense of any claim. Social Fibre reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by You.

THE SERVICE, THE SOFTWARE, THE REPORTS, AND ALL RELATED AND ANCILLARY SERVICES ARE PROVIDED "AS IS" AND THERE ARE NO WARRANTIES, CLAIMS OR REPRESENTATIONS MADE BY SOCIAL FIBRE AND AFFILIATES, EITHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE SERVICES AND REPORTS, INCLUDING WARRANTIES OF QUALITY, PERFORMANCE, NON–INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, NOR ARE THERE ANY WARRANTIES CREATED BY COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE. SOCIAL FIBRE DOES NOT WARRANT THAT THE SERVICES OR REPORTS WILL MEET YOUR NEEDS OR BE FREE FROM ERRORS, OR THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED. THE FOREGOING EXCLUSIONS AND DISCLAIMERS ARE AN ESSENTIAL PART OF THIS AGREEMENT AND FORMED THE BASIS FOR DETERMINING THE PRICE CHARGED FOR THE SERVICE.

IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

Refund Policy Statement
All sales of all Social Fibre services are final. No refunds shall be given by Social Fibre, for any amounts paid for services, including, without limitation, any service charges or fees. Further, the Customer acknowledges and accepts the risk that Social Fibre may not succeed in finding all Internet content about the Customer or the Named Party (e.g. the Customer's child) whom the Customer designates as the person about whom Social Fibre will undertake searches for Internet content. The Customer also acknowledges and accepts the risk that Social Fibre., may not succeed in effecting the removal and/or alteration of any Internet content about the Customer or the Named Party (e.g. the Customer's child) whom the Customer designates as the person about whom Social Fibre will undertake to effect the removal and/or alteration of Internet content. No refunds shall be given by Social Fibre for any reason. As the Customer can appreciate, the Company's work is quite difficult, and we will do our best, but we are not able to make any guarantees.

Dispute Resolution
In the unlikely event that you have a problem or difficulty with Social Fibre or the Services please contact us at legal@socialfibre.com.au. You must make a good faith effort to work out problems with us directly before invoking legal process. Similarly, we'll make reasonable business efforts to work out problems directly with you before we take other steps.

Miscellaneous; Integration; Applicable Law and Venue
Social Fibre shall be excused from performance hereunder to the extent that performance is prevented, delayed or obstructed by causes beyond its reasonable control. Among many other factors, our services depend heavily on privacy law in the Australia, the various States and Territories, and other jurisdictions. The law can and will change in the future and such changes are outside the control of Social Fibre. We cannot predict the impact of future changes in the law. Some legal changes, including but not limited to legislation or judicial interpretation, may render it more difficult or impossible for us to perform the services offered.

This Agreement (including any amendment agreed upon by the parties in writing) represents the complete agreement between us concerning its subject matter, and supersedes all prior agreements and representations between the parties. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed to the extent necessary to make it enforceable to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.

This Agreement shall be governed by and construed under the laws of Australia without reference to its conflict of law principles. In the event of any conflicts between foreign law, rules, and regulations, and Australia law, rules, and regulations, Australia law, rules and regulations shall prevail and govern. Each party agrees to submit to the exclusive and personal jurisdiction of the courts of Australia.

A waiver of any default is not a waiver of any subsequent default. You may not assign or otherwise transfer any of Your rights hereunder without Social Fibre’s prior written consent, and any such attempt is void.
